2. Description of Service
Protection Pete is a lead generation platform. We provide a service that connects consumers with third-party licensed insurance agents, brokers, or carriers ("Service Providers"). We are not an insurance carrier, agent, or broker. We do not issue insurance policies, provide legal or tax advice, or guarantee that any specific Service Provider will offer you coverage or a specific rate.
3. Eligibility
You must be at least 18 years of age and a legal resident of the United States to use this Site and submit a request for information.
4. Accuracy of Information
By submitting a request, you agree to provide accurate, current, and complete information. Providing false or misleading information may result in your inability to obtain insurance coverage and could potentially lead to legal consequences.
5. Consent to Communication (TCPA)
This section applies to both consumers who submit their information through the Site to request insurance information and to agents, brokers, carriers, and other Service Providers who receive leads from us.
Consumers: By submitting your contact information, you provide your express written consent for TKG Ventures LLC and our partner Service Providers to contact you for marketing purposes at the phone number and email address you provided. This may include:
- Live phone calls.
- Automated or prerecorded voice messages.
- Text messages (SMS/MMS). This consent applies even if your number is currently listed on any internal, corporate, state, or federal Do Not Call registry. Your consent is not a condition of purchase.
Agents and Service Providers: By registering, purchasing leads, or otherwise engaging with TKG Ventures LLC to receive leads, you provide your express written consent for us and our affiliates to contact you at the phone number(s) and email address(es) you provide. This includes the delivery of leads and related communications via automated text messages (SMS/MMS), automated or prerecorded voice messages, live phone calls, and email, sent as frequently as necessary to deliver leads and service your account. This consent applies even if your number is listed on any internal, corporate, state, or federal Do Not Call registry, and is not a condition of any purchase. You may opt out at any time by replying STOP to text messages or by contacting us, with the understanding that opting out may prevent us from delivering leads to you.
6. No Guarantee of Results
Insurance rates and coverage options are determined solely by the insurance carriers and their representatives. TKG Ventures LLC makes no guarantees regarding the availability of insurance, the quality of service provided by third-party partners, or that the rates offered will be the lowest available in the market.
7. Lead Exclusivity
Leads generated through this Site are shared with multiple Service Providers by default. A lead will only be considered exclusive to a single Service Provider if it is expressly advertised, described, or designated as "exclusive" at the time of sale or delivery. Unless a lead is explicitly marketed or labeled as exclusive in the applicable offering, order, or written agreement, it is non-exclusive and may be distributed to more than one Service Provider. Where a lead is advertised or described as exclusive, TKG Ventures LLC will not knowingly resell or redistribute that lead to any other Service Provider.
8. Lead Delivery to Agents
Leads generated through this Site will be delivered to Service Providers and agents via automated text message (SMS/MMS) and/or email as frequently as possible, including in real time or near real time after submission. By participating as a Service Provider or agent, you consent to receiving these automated communications at the phone number(s) and email address(es) you provide for the purpose of lead delivery. Consumers acknowledge that their submitted information will be transmitted to one or more Service Providers through these automated channels in order to facilitate timely follow-up.
9. Limitation of Liability
To the fullest extent permitted by law, TKG Ventures LLC and its officers, directors, and employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Site or your interactions with any third-party Service Provider.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law principles.
11. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised terms.
